What Is Probate?

The probate process is a court-supervised enforcement of the provisions of a last will and testament. When an individual passes, most of their property will be entered into that person’s estate, which an executor is charged with managing and maintaining. Most of my clients are executors who need assistance with their duties. When you are appointed as an executor, you are responsible for ensuring that all the necessary taxes are paid and that the wishes and distributions contained in the will are properly distributed to the correct beneficiaries. Probate can cost between 3% and 8% of the value of an estate after all the costs, court fees, taxes and other expenses are accounted for.

Executors have a unique duty during the probate process. As an executor you are responsible for the well-being of the estate and must act with its best interests in mind. This can be difficult to navigate, especially if you are a close family member of the deceased and are dealing with other family members who may be taking their grief out on you unfairly.
